FULL RECOMMENDATION
INDUSTRIAL RELATIONS ACTS, 1946 TO 1990 SECTION 26(1), INDUSTRIAL RELATIONS ACT, 1990 PARTIES : UNIVERSITY COLLEGE GALWAY (REPRESENTED BY IRISH BUSINESS AND EMPLOYERS' CONFEDERATION) - AND - IRISH MEDICAL ORGANISATION DIVISION : Chairman: Mr Duffy Employer Member: Mr McHenry Worker Member: Ms Ni Mhurchu |
1. Supplementary Recommendation to LCR16403.
BACKGROUND:
2. The following Recommendation is made supplementary to LCR16403.
RECOMMENDATION:
The Court notes that the allowance now claimed by the Union is paid in only two of the five medical schools in Ireland. The Court does not accept that this in itself provides a sufficiently sound basis on which it could recommend an extension of the allowance to the claimants.
The present claim has been under discussion between the parties over a prolonged period. Over that time an expectation may have arisen that some concession would be made by the College. In that regard, it is noted that, in discussions following the issue of LCR16403, the College offered a once off lump-sum in settlement of the claim. The Court recommends that the College improve its offer to one of £20,000 (25,394.76 Euros) per individual associated with the claim, and that this be accepted in full and final settlement of the claim.
Signed on behalf of the Labour Court
