1. Alleged non-implementation of Rights Commissioner's Decision WT4734/01/CW.
BACKGROUND:
2. The worker appealed Rights Commissioner's decision WT4734/01/CW to the Labour Court on the 9th of October, 2001, in accordance with Section 28(8) of the Working Time Act, 1997. A Labour Court hearing took place on the 30th of October, 2001. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 (the Act) by Anthony McNamee, Cloneylogan, Kildalkey, Co. Meath, that his former employer Noel Hughes, Pluckstown, Athboy, Co. Meath, failed to implement a decision of a Rights Commissioner WT4734/01/CW dated 23/08/2001,
and the said Decision not having been carried out by the Employer, and no appeal having been brought against the said Decision within the time limit for such an appeal,
The Court hereby determines that the said employer pay to the said employee the sum of £360 (457.11 Euro) in respect of holiday pay in accordance with the Decision of the Rights Commissioner.
The Court so determines.
