1. Alleged non-implementation of Rights Commissioner's Decision WT4668/01/GF
BACKGROUND:
2. The worker referred his case to the Labour Court on the 31st of July, 2001, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Gerard Valente of 67 The Heights, Melrose Park, Swords, Co. Dublin that his former employer Paul Corry trading as Belgrave Cleaning Services, 12 Stanaway Road, Unit 7, Crumlin Industrial Estate, Dublin 12, failed to implement a decision of the Rights Commissioner No. WT4668/01/GF dated the 13th of June, 2001,
and the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee £480 (609.47 Euro) in respect of holiday pay in accordance with the decision of the Rights Commissioner.
