1. Alleged non-implementation of Rights Commissioner's Decision WT4543/01/TB.
BACKGROUND:
2. A Labour Court hearing took place on the 16th of October, 2001.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, (the Act), by Mr Alan Duggan, 7 Fairways, Cloghroe, Co. Cork, that his former employer Mr Michael Malone trading as Malone's Bar, Blarney, Co. Cork, failed to implement a Decision of a Rights Commissioner No. WT4543/01/TB, dated the 10th of July, 2001.
And the said Decision not having been carried out by the employer,
And, no appeal having been brought against the said Decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee £156 (198.08 Euro) in respect of holiday pay in accordance with the Decision of the Rights Commissioner.
The Court so determines.
