1. Appeal by workers for implementation of Equality Officer's Recommendation Dec - E - 2001/5.
BACKGROUND:
2. The workers appealed their case to the Labour Court on the 7th of March, 2001, in accordance with Section 21 of the Employment Equality Act, 1977. Labour Court hearings took place on the 29th of June, and the 20th and 21st of September, 2001.
DETERMINATION:
The material facts of this case, together with the findings and conclusions of the Court, are as recited in Determination No. DEE021 entitled "Two Female Teachers v A Boys' secondary school".
The Respondent appealed to the Court against the Recommendation of the Equality Officer. The Court's Determination in that appeal is set forth in the said Determination No. DEE021. As appears from the said Determination, the Court heard the case de-novo and found that the Respondent had discriminated against the claimants. The Court awarded the first named claimant compensation in the amount of euro 10,000 and the second named claimant euro 20,000.
In these circumstances, the question of implementing the Equality' Officer's Recommendation does not arise.
