1. Alleged non-implementation of Rights Commissioner's Decision WT2894/00/MR.
BACKGROUND:
2. A Labour Court hearing took place on the 6th of December, 2001. The following is the Court's determination:-
DETERMINATION:
A complaint, having been made under Section 28(8) of the Organisation of Working Time Act, 1997, (the Act) by Ms. Mary McInerney, 48 Riverside Drive, Shannonbanks, Corbally, Co. Limerick, that her former Employer, Mr. Alphonsus Franklin Junior, trading as Franklin Shoe Care Centre, Parnell Street, Limerick, failed to implement a decision of a Rights Commissioner, No. WT2894/00/MR dated the 14th of August, 2001,
And the said Decision not having been carried out by the Employer,
And no appeal having been brought against the said Decision within the time limit for such an appeal,
The Court, hereby determines that the said Employer pay to the said Employee the sum of £1,076 (1,366.24 Euro) in respect of holiday pay and compensation in accordance with the Decision of the Rights Commissioner.
The Court so determines.
