1. Complaint that Rights Commissioner's Decision has not been implemented WT3939/01/GF.
BACKGROUND:
2. The worker referred his case to the Labour Court on the 21st of May, 2001, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. A hearing took place on the 27th of June, 2001. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28 (8) of the Organisation of Working Time Act, 1997, by Kevin Marum, 82 Knockmay Estate, Portlaoise, Co. Laois that his employer Paul Hyland trading as Emo Tougher Developments, Emo, Portlaoise, Co. Laois failed to implement the decision of a Rights Commissioner NO. WT3939/01/GF dated 5th April, 2001,
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limit for such appeals,
The Court hereby determines that the said employer pay the sum of euro 780.94 for annual leave in accordance with the decision of the Rights Commissioner.
