1. Alleged non-implementation of Rights Commissioner's Decision MW7055/01/JH.
BACKGROUND:
2. The worker referred his case to the Labour Court on the 16th of May, 2002, in accordance with Section 31(1) of the National Minimum Wage Act, 2000. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act, 2000, (the Act), by Patrick Kehoe, 31 Mt. Carmel, New Ross, Co. Wexford that his employer, Lacken Joinery Limited trading as Staircase Manufactures, Lacken, New Ross, County Wexford, failed to implement a decision of a Rights Commissioner No. MW7055/01/JH, dated the 22nd March 2002,
and the said decision not having been carried out by the employer,
and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €3,795.18 in respect of the underpayment of his wages and €300 compensation, in accordance with the decision of the Rights Commissioner.
The Court so determines.
