SUBJECT:
1. Alleged non-implementation of Rights Commissioner's Decision WT6206/01/TB.


BACKGROUND:

2. The worker appealed the Rights Commissioner's Decision No. WT6202/01/TB to the Labour Court on 25th March, 2002, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. A Labour Court hearing took place on 14th May, 2002. The following is the Court's Determination:


DETERMINATION:

A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Ms. Martina O'Riordan, 37 Sycmore Avenue, Carpenterstown, Castleknock, Dublin 15, that her employer Sheldon Park Hotel, Kylemore Road, Ballyfermot, Dublin 12, failed to implement a decision of a Rights Commissioner No. WT6206/01/TB dated 25th January, 2002,

And the said Decision not having been carried out by the employer,

And no appeal having been brought against the said Decision within the time limit for such appeals,




The Court hereby determines that the said employer pay the sum of €366 in respect of holidays in accordance with the Decision of the Rights Commissioner.

Please note: The Labour Court has no jurisdiction to hear appeals under the Payment of Wages Act, 1991.
