INDUSTRIAL RELATIONS ACTS, 1946 TO 2001 SECTION 26(1), INDUSTRIAL RELATIONS ACT, 1990 PARTIES : SKYLON HOTEL - AND - SERVICES INDUSTRIAL PROFESSIONAL TECHNICAL UNION DIVISION : Chairman: Mr Duffy Employer Member: Mr Keogh Worker Member: Ms Ni Mhurchu |
1. Re-hearing arising from LCR 17075.
BACKGROUND:
2. This is a re-hearing of a case which was originally heard on the 13th of February, 2002.
LCR - 17075 refers.
RECOMMENDATION:
In LCR 17075 the Court recommended that the Union should accept the decision of management to discontinue the lunch service provided by the hotel. The parties were asked to address the issue of redeployment and the consequential adjustments which would have to be made in rosters. The Court also proposed that the question of compensation for any negative or disruptive affect on the staff should be discussed between the parties.
The Court recommends that the rosters and other changes proposed by management should be accepted. It is noted that lump sums have been offered ranging in value from €500 to €800. The Court recommends that this offer be improved to provide lump-sums ranging in value from €750 to €1,200.
The Court also suggests that the Company might consider offering an exit package to staff affected by the changes, who are unable to adopt to the new arrangements. Any such package should be negotiated between the parties having regard to the norm for voluntary severance in the sector.
Signed on behalf of the Labour Court
