1. Appeal by the worker of Rights Commissioners Decision WT5541/01/JH.
BACKGROUND:
2. The Court heard the appeal on the 22nd January, 2003. The Court's Determination is as follows:
DETERMINATION:
At the commencement of the hearing the claimant indicated that he did not take issue with the Rights Commissioner's decision in relation to holiday pay. He said that there were other matters which he wished to pursue in relation to the Organisation of Working Time Act, 1997.
Since the alleged infringement of the Act in respect of holiday pay was the only matter dealt with by the Rights Commissioner in the decision under appeal, and since that decision is not contested by the claimant, there is nothing before the Court on which it is required to adjudicate.
Accordingly, the appeal herein is dismissed and the decision of the Rights Commissioner is affirmed.
