1. Alleged non-implementation of Rights Commissioner's Decision WT9075/02/Fl.
BACKGROUND:
2. An application has been made by the employee that Decision No. WT 9075/02/FL has not been implemented by the employer.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Michael Doyle, 27 Talbot Street, Wexford, that his former employer, Michael Furlong, Misterin, Adamstown, Co. Wexford, failed to implement a decision of a Rights Commissioner WT 9075/02/FL dated 22nd January, 2003.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €3,500 in respect of compensation for various infringements of the Act, in accordance with the decision of the Rights Commissioner.
