1. Alleged non-implementation of Rights Commissioner's Decision PT9829/02/GF.
BACKGROUND:
2. An application has been made by the employee the Decision No. PT 9829/02/GF has not been implemented by the employer.
DETERMINATION:
An application having been received for the implementation of the decision of the Rights Commissioner in relation to a claim by Ms Gemma Cresham, Rosslee, Kilkenny Cross, Castlebar, against her employer Heatons Limited, Heaton House, IDA Business Park, Whitestown, Tallaght, Dublin 24, PT 9829/02/GF dated 14th March, 2003 and the said decision not having been appealed by the employer or implemented within the time specified in the Act, the Court hereby determines that the said employer implement the Rights Commissioner's decision in accordance with the provisions of the Protection of Employees (Part-Time Work) Act, 2001.
