1. Alleged non-implementation of Rights Commissioner's Decision MW9051/02/JH.
BACKGROUND:
2. An application has been made by the employee that Decision No. MW 9051/02/JH has not been implemented by the employer.
DETERMINATION:
A complaint having been received under the National Minimum Wage Act, by Ms Ludmilla Jelagina, 43 Cherrywood Drive, Drogheda, Co Louth that her former employer, Mr. Peter McArdle, failed to implement a decision of a Rights Commissioner MW9051/02/JH, dated 11th February, 2003.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €2255 in settlement of her claim under the National Minimum Wage Act, 2000 in relation to the under payment of wages.
