1. Alleged non-implementation of Rights Commissioner's Decision WT9476/02/LM.
BACKGROUND:
2. The worker referred his case to the Labour Court on the 16th of January, 2003, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Christopher Lynch, Doon North, Tralee, Co. Kerry, that his former Employer, Timothy O'Riordan, 9 Russell Street, Tralee, Co.Kerry failed to implement a decision of a Rights Commissioner No. WT9476/02/LM, dated the 26th of November, 2002,
And the said decision not having been carried out by the Employer, and no appeal having been brought against the decision within the time limit for such an appeal,
The Court hereby determines that the said Employer pay to the said Employee the sum of €1,584 in respect of public holiday pay and annual leave in accordance with the decision of the Rights Commissioner.
