1. Alleged non implementation of Rights Commissioners Decision WT18407/04/MMG
BACKGROUND:
2. A Labour Court hearing took place on the 25th November, 2004. The Court's Determination issued as follows:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Ms. Amy Chamberlain, 66 Hazelwood, Gorey, Co. Wexford. that her employer Francis Dooley T/A Skip Con Limited, Courtowm, Co.Wexford failed to implement a decision of a Rights Commissioner No. WT18407/04/MMG dated 27th August 2004,
and the said decision not having been carried out by the employer,
and no appeal having been brought against the said decision within the time limit for such appeals,
the Court hereby determines that the said employer pay the sum of €750 in respect of the claim under the Act, in accordance with the decision of the Rights Commissioner.
