1. Alleged non-implementation of Rights Commissioner's Decision MW12118/02/LM
BACKGROUND:
2. A Labour Court hearing took place on the 3rd March, 2004. The following is the Court's determination:
DETERMINATION:
A complaint having been received under the National Minimum Wage Act, by Ms Lynn Mulledy, 199 Castletown, Leixlip, Co. Kildare that her former employer, Acorn Equestrian Limited, having its registered office at Abbeyfarm House, Killadoon Road, Celbridge, Co. Kildare failed to implement a decision of a Rights Commissioner MW12118/02LM, dated 7th October, 2003.
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €2,789 in settlement of her claim under the National Minimum Wage Act, 2000 in relation to the under payment of wages in accordance with the decision of the Right's Commissioner.
