1. Request for a Determination in relation to a Labour Court Recommendation LCR 17897.
BACKGROUND:
2. A Labour Court hearing took place on the 21st September, 2004 in relation to the above and the Court's Determination issued as follows:
DETERMINATION:
Pursuant to the further hearing held on 21st September, 2004 in regard to the implementation of LRC 17897 dated 12th July 2004, the Court orders as follows:-
Rates of Pay:
The following rates of pay should apply with effect from the 1st October, 2004.
Start Rate €300 per week
After 1 year €320 per week
After 2 years €340 per week
After 3 years €360 per week
These rates should apply for 12 months from that date. Any operative on a higher rate than €360 per week should hold their personal differential (on a percentage basis) above the 3 year rate.
Service Pay:
The Company shall re-examine this issue three years after the date of Labour Court Recommendation LCR17897.
Shift Premiums,
The Company shall implement the Court's original recommendation number LCR17897 backdated to the date of the recommendation.
Sick Pay Scheme
The Company shall re-instate the sick pay scheme with effect from the 1st August, 2004.
Safety, Health and Welfare
The Company will institutionalise and continue its current practice, as per Recommendation LCR17897.
Pension Scheme/Trustees:
The Company will institutionalise and continue its current practice, as per Recommendation LCR17897.
Bonus Scheme:
As indicated at the original hearing, the Company shall re-instate the bonus scheme when performance improves and shall make individual and Company targets clear to all employees.
Anti-Bullying & Harassment/Grievance & Disciplinary Procedures:
The Company shall update its policies in a manner consistent with the Court's original recommendation LCR17897, and will release them to all employees.
