1. Hearing arising from LCR17176.
BACKGROUND:
2. LCR 17176 issued in June, 2002. The claim was on behalf of 30 waterworks and sewage caretakers and was for the introduction of an on-call / call-out payment. The Union was seeking an annual retainer of €2,540 plus €63.50 per call plus three hours at treble time (at a minimum), (full details of the dispute are contained in LCR 17176). The Court recommended that the allowance should be considered within the parallel benchmarking process for Local Authorities which was to be completed in October, 2002. Failing a resolution at that stage, the dispute could be referred back to the Court. As the parties did not reach agreement, the Union referred the claim back to the Court in April, 2004, and a hearing took place on the 23rd of March, 2005, in Castlebar, the earliest date suitable to the parties. The following is the Court's recommendation.
RECOMMENDATION:
The Court notes that negotiations have taken place between the Union and management in relation to the introduction of a national on-call system. It is further noted that proposals have been forwarded to the Union in that regard. In the Court's view the current dispute should be resolved in the context of what emerges from the negotiations.
The Court so recommends.
