1. Appeal against Rights Commissioner's Recommendation IR17399/03/JH.
BACKGROUND:
2. The appeal concerns a worker who was employed by the Company from 3rd February, 2003 to 13th October, 2003 when his employment was terminated by reason of redundancy. The worker claimed that he was unfairly treated and referred the issue to a Rights Commissioner for investigation. On the 1st June, 2004 the Rights Commissioner issued her recommendation as follows:
Based on the submissions made and for the reasons set out in the foregoing I recommend that Parkview Food Services Limited pay the worker the sum of €1,000 as a severance payment on termination of his employment and that this amount be accepted in full and final settlement of any claims by the worker against his former employer".
(The worker was named in the Rights Commissioner's recommendation).
On the 29th June, 2005 the worker appealed the Recommendation to the Labour Court.
A Labour Court hearing was scheduled to take place on the 19th July, 2005. However, neither party attended for the hearing of the case.
DECISION:
Neither party appeared at the hearing of this appeal. In these circumstances the Court decides that the appeal be struck out and that the recommendation of the Rights Commissioner be affirmed.
The Court so decides.
