FULL RECOMMENDATION

1. Request by the Union for a Determination in relation to Labour Court Recommendation No. LCR 18111.
BACKGROUND:
2. A Labour Court hearing was held on the 30th May, 2005.
DETERMINATION:
(1) The Court notes that the parties have, subsequent to the issue of LCR 18111, agreed on the following matters,
-Rates of Pay/Service Pay
-Service Leave
- Shift Premia
- Sick Pay Scheme
- Pension Scheme
-Protective Clothing
As these matters are no longer in contention between the parties, the Court does not need to determine on them at this time.
(2)Grievance and Disciplinary Procedure:- The Court determines that the procedure should be amended in such a manner that ensures its full compliance with the Code of Practice No. 146 of 2000, as set out in LCR 18111.
(3)Overtime:The Court determines that overtime be paid for all hours over 39 per week. Subject to this, hours outside the scope of the normal working week should be paid for at the appropriate premium.
