1. Alleged non-implementation of Rights Commissioner's Decision WT19388/04/JC.
BACKGROUND:
2. A Labour Court hearing took place on the 13th October, 2004. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Chao Ma of 178 Clifdon Court Ellis Quay, Dublin 7, that his former employer, Paul Melia trading as Abbey Service Station, 109 Dorset Street Upper, Dublin 1 failed to implement a decision of a Rights Commissioner WT19388/04/JC,
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €1,176 in accordance with the decision of the Rights Commissioner.

In exercise of its powers under Section 39(2) of the Organisation of Working Time Act, 1997 the Court determines that the name of the employer in Determination No. DWT0446 shall be changed from PAUL MELIA trading as ABBEY SERVICES STATION to P & N Oils Limited, registered office at 12, North Main Street, Naas, Co. Kildare..
