1. Dispute
1.1 This dispute concerns a claim by Dermot Ryan that on 13 April 2003, he was treated in a discriminatory manner by the respondent. The complainant referred a claim to the Director of Equality Investigations under the Equal Status Act 2000. In accordance with her powers under section 75 of the Employment Equality Act 1998 and under the Equal Status Act 2000, the Director then delegated the case to me, Dolores Kavanagh, an Equality Officer, for investigation, hearing and decision and for the exercise of this and other relevant functions of the Director under Part III of the Equal Status Act.
2. Summary of Complainants' Case
2.1 The complainant stated in his written complaint that they were discriminated against, on the basis of gender, age and race, by the respondent on 13 April, 2003 when he was refused entry to the respondent premises.
3. Summary of Respondent's Case
3.1 The respondent did not submit any written material to the Tribunal in this matter.
4 Outcome of Hearing - Prima Facie Case
4.1. Neither the complainant nor the respondent attended at the scheduled Hearing of this complaint on 26 April 2006. As the complainant was not present at the Hearing he failed to establish a prima facie case of discrimination on any of the grounds under the Equal Status Act 2000.
5 Decision
The complainant has not established a prima facie case of discrimination on any of the grounds under the Equal Status Act 2000. I find therefore in favour of the respondent.
