1. Request by the Union for a Determination in relation to Labour Court Recommendation No.18404.
BACKGROUND:
2. A Labour Court hearing was held on the 2nd March, 2006 following which the Court issued Recommendation No.18404. The Union states that the dispute has not been resolved and now requests the Court to issue a Determination under Section 6(1) of the Act. Having heard the evidence the Court is of the opinion that the dispute, the subject matter of Recommendation 18404, has not been resolved and now makes the following Determination in respect of the workers represented by the Union.
DETERMINATION:
Pay:
The Court determines that the hourly rate of pay for day operation should be €10.50 x 15 points to €12.15 with effect from 1st August 2005. Other rates referred to the Court to be adjusted pro rata.
Shift Premium:
The Court determines that the shift rates be 33% for permanent nights and 20% for double day shifts with effect from 1st August 2005.
Sick Pay Scheme:
The Court determines that a scheme giving 4 weeks’ sick pay per year should apply with effect from 1st January 2006.
Sunday Premium:
The Court determines that rostered Sunday hours be paid at a rate of time and a half and overtime on Sundays be paid at double time.
ESOP:
The Court makes no determination on this matter.
Grievance & Disciplinary Procedures in line with S.I. 146 of 2000:
The Court determines that the procedures proposed to the Union by the Company in August 2005, which the Company agreed will be in conformity with S.I. 146 of 2000, should be implemented. Any dispute concerning the compatibility of this procedure with the provisions of the Code of Practice should be processed through the procedures contained in S.43 (1) of the Industrial Relations Act, 1990.
