1. Alleged non implementation of a Rights Commissioner's Decision No. R-038965-WT-05-TB.
BACKGROUND:
2. A Labour Court hearing took place on the 11th August, 2006. The following is the Court's determination:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 from Patrick McDonagh, of 269 Arden View, Tullamore, Co. Offaly, that his former employer, Liam Middleton trading as A Cabs, having his place of business at Lahinch, Kilmucklin, Tullamore, Co. Offaly failed to implement a decision of a Rights Commissioner, No. R-038965-WT-05-TB,
And the said decision not having been carried out by the employer and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee the sum of €250.00 in accordance with the Decision of the Rights Commissioner.
