1. Request by a Trade Union for a Determination in relation to Labour Court Recommendation No. LCR 18280
BACKGROUND:
2. A Recommendation , LCR 18280, issued in this case on the 28th July, 2005. The Union applied under Section 6(1) of the Act, for a Determination pertaining to the said case. A Labour Court hearing took place on the 24th October, 2005, and taking into account the requirements of Section 6(3)(a) of the Act, the Court makes the following Determination in respect of the workers represented by the Union.
DETERMINATION:
Pay:With effect from 1st January, 2005, the Determination of the Court is as follows:-
€21500 (start rate)
€23000 (after 1 year)
€24500 (after 2 years)
€26000 (after 3 years)
Shift Premium:To be increased as follows:-
for 2- shift:- 22%
This should be done on a phased basis as follows:-
to €3815with effect from 1st October, 2005,
to €4100with effect from 1st January, 2006,
to €4400with effect from 1st April, 2006,
to €5760with effect from 1st July, 2006,
for 3- shift - 30%, with 33.3% for rotating shift
On Call / Call Out:To be increased as follows:-
to €2500with effect from 1st October, 2005,
to €3000with effect from 1st January, 2006,
to €4000with effect from 1st July, 2006,
Sunday Premium:To be €30 with effect from 1st October, 2005. To attract
national or local percentage pay increases.
Bank Holidays:3 years' value of outstanding Bank Holiday payments to be paid, half from 1st October, 2005, and half from 1st October, 2006.
VHI:The Company's offer (i.e. 10% discount -group scheme) to be accepted and implemented.
Bonus:In the light of the implementation of the Pay Determination, the Court makes no decision on this matter at this time.
Pensions: The Company offer of 5% contribution from each side to be implemented as soon as it can be.
Overtime: To be paid for all hours over 39 per week.
