1. Non-payment of holiday pay - Rights Commissioner Decision WT10632/02/MR.
BACKGROUND:
2. The worker sought implementation of the Rights Commissioner's decision on the 9th of November, 2005. The following is the Court's determination:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Lindsay Courtney, formerly Lindsay Beer, of Swing - a - Cat Cottage, Station Road, Cheltenham, Gloucestershire GL54 2AA, England, that her former employer, Sandyline Limited trading as Munster Hotel, Cathedral Street, Thurles, Co. Tipperary, failed to implement a decision of a Rights Commissioner WT10632/02/MR,
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €2,961.41 in accordance with the decision of the Rights Commissioner.
