1. Compensation for re-location - Work Inspection arising from LCR18327.
BACKGROUND:

This is a claim on behalf of 17 nurses for compensation for losses incurred, increased costs and significant workplace changes experienced due to the amalgamation of Acute Mental Health Services between Vergemount Acute Services and St. Camillus Acute Services into one new unit in St. Vincent's Hospital, Elm Park. A Labour Court hearing took place on the 8th September 2005 and a Labour Court Recommendation LCR No. 18327 was issued on the 23rd September, 2005. The recommendation stated"If the difficulties are not resolved within 6 weeks from the date of this recommendation, the Court will consider recommending some form of compensation for the inconvenience and irritation involved".
As some of the issues concerned were not resolved, the Unions requested a recommendation for "compensation for the inconvenience and irritation involved", on the 10th February, 2006. A work inspection was carried out by the Labour Court on the 27th February, 2006. The following is the Court's recommendation:
RECOMMENDATION:
Arising out of LCR No: 18327, the Court carried out a work inspection of the areas identified by the parties which remained the subject of dispute. In LCR No: 18327 the Court indicated that it was concerned at the length of time it had taken to address the “snag list” in the new facility and accordingly recommended as follows:
- If the difficulties are not resolved within six weeks from the date of this recommendation the Court will consider recommending some form of compensation for the inconvenience and irritation involved.
