1. Appeal against Rights Commissioner's Recommendation IR20650/04/JH
BACKGROUND:
2. The worker referred her case to a Rights Commissioner whose recommendation was as follows:
"Based on the submissions made and for the reasons set out in the foregoing I recommend that Mid Media Ltd - The Athlone Voice pay to the worker the sum of €10,000 in settlement of any claim by her related to the termination of her employment or any expenses or other financial claims on her behalf. I further recommend that Mid Media Ltd put in place a full grievance and disciplinary procedure together with an anti-bullying policy as a matter of urgency".
(The worker was named in the above recommendation)
The employer appealed the recommendation to the Labour Court on the 18th of April, 2005, in accordance with Section 13(9) of the Industrial Relations Act, 1969. A hearing took place in Athlone Courthouse on the 28th of September, 2006. Both parties were notified by registered post of the hearing but the employer failed to attend.
DECISION:
As the party appealing the recommendation did not attend the hearing in order to move its appeal, the appeal is struck out. The Court upholds the Rights Commissioner's recommendation and awards the worker the sum of €10,000.
