1. Alleged non-implementation of Rights Commissioner's Decision R-041922-WT-06/PO'B.
BACKGROUND:
2. A Labour Court hearing took place on the 6th March, 2007. The following is the the Courts Determination.
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 ( the Act) by Neil Forde, Apartment 3, 107 Capel Street, Dublin 1. that Owen Molloy trading as Owen Molloy Painting & Decorating Contractors of 41 Estuary Court, Swords, Co. Dublin failed to implement a decision of a Rights Commissioner, No. R-041922-wt-06/POB and dated 4th July, 2006.
And the said decision not having been carried out by the employer,
And no appeal having been brought against the said decision within the time limit for such appeals,
The Court hereby determines that in accordance with the decision of the Rights Commissioner the said employer pay the complainant the sum of €1,802.95 in respect of his complaint under the Organisation of Working Time Act, 1997.
