Sean Maher referred a claim of discrimination on the disability ground to the Director of Equality Investigations under the Equal Status Act 2000. In accordance with her powers under section 75 of the Employment Equality Act, the Director then delegated the case to me, Bernadette Treanor, an Equality Officer, for investigation, hearing and decision and for the exercise of other relevant functions of the Director under Part III of the Equal Status Act.
Background
This case was assigned to me on 17th July 2007. On 11th September 2007 I wrote to the complainant and respondent informing them that the hearing would take place on 11th October 2007. The complainant was also asked to submit evidence of his notification as required by Section 21 of the Act. This correspondence was sent to the No response was received and the hearing went ahead as scheduled. The complainant failed to appear. On that basis the complainant has failed to support his claim of discrimination and therefore he has failed to establish a prima facie case of discrimination on the disability ground.
