1. Alleged non-implentation of Rights Commissioner's Decision WT22122/04/MR.
BACKGROUND:
2. The Worker referred his case to the Labour Court on the 18th of July, 2007, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working time Act, 1997, by Tom Baker of 127 Delmere Park, Moyross, Co. Limerick, that his former employer Pegasus Security Group Limited of 24 Eglantine Avenue, Belfast, BT9 6DW, Northern Ireland, (and having offices within the State at 39 Windsor Court, Castletroy View, Limerick) failed to implement a decision of the Rights Commissioner WT22122/04/MR,
and the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
the Court hereby determines that the said employer pay to the said employee €2,000 in accordance with the decision of the Rights Commissioner.
