1. Request by the Union for a Determination in relation to Labour Court Recommendation No. LCR18583.
BACKGROUND:
2. A Labour Court hearing was held on the 24th January, 2007.
DETERMINATION:
On 22nd May 2006 the Court issued Recommendation LCR18583 in a dispute between O’Connor Meats Ltd and SIPTU, pursuant to Section 5 of the Industrial Relations (Amendment) Act 2001, as amended. By letter dated 23rd June 2006 the Union sought a determination in the dispute pursuant to Section 6 of the Act.
The Court is satisfied that the dispute has not been resolved and that it is expedient for it to make a determination. The Court is further satisfied that the Recommendation was not based on unsound or incomplete information. Accordingly, the determination must be in the same terms as the recommendation.
The Court determines as follows: -
Pay.
The Court determines that basic pay of semi-skilled butchers be increased to €8.50 per 39 hour working week. In addition a guaranteed bonus should be paid of 33.33% of basic pay.
Overtime.
The Court determines that all overtime worked in excess of 39 hours should be paid at time and one half and that any work done on Sunday should be paid at double time.
Sick Pay.
The Court determines that the company introduce a sick-pay scheme providing for up to six weeks sick leave with full pay, less social welfare, per year. All illness covered by the scheme should be covered by a medical certificate. The scheme should not operate in respect of the first three days of illness.
Implementation.
Save where otherwise appears the determinations contained herein should be implemented within one month from the date hereof retrospective to the date envisaged by the Recommendation, namely 21st June 2006. With respect to the guaranteed bonus recommended, the effective date should be 23rd February 2007.
