1. Alleged non-implementation of Rights Commissioner's Decision R-042361-Wt-06/TB.
BACKGROUND:
2. The worker referred her case to the Labour Court on the 28th November, 2006, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Court's Determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997, by Louise Mulheron of 29, Meadow Hill, Letterkenny, Co. Donegal, that her former employer Julian Jordan trading as Tempest - French Connection of Link Road, Letterkenny, Co Donegal failed to implement a Decision of a Rights Commissioner No. 42361/WT /06/TB,
and the said Decision not having been carried out by the employer, and no appeal having been brought against the said Decision within the time limit for such appeal,
the Court hereby determines that the said employer pay to the said employee €750.00 in accordance with the Decision of the Rights Commissioner.
