Eamonn Maughan referred a claim to the Director of Equality Investigations under the Equal Status Act 2000. In accordance with her powers under section 75 of the Employment Equality Act, the Director then delegated the case to me, Bernadette Treanor, an Equality Officer, for investigation, hearing and decision and for the exercise of other relevant functions of the Director under Part III of the Equal Status Act.
Background
On 9th august 2007 The Tribunal wrote to the complainant and the respondent informing them that a hearing of the case would take place on 6th September 2007 in Castlebar. The correct address for the complainant as submitted was used. On the day of the hearing the respondent was present with a number of witnesses who had taken time off work to attend. The complainant did not appear.
Conclusions of the Equality Officer
I am satisfied that the complainant was notified about the hearing. Since he failed to appear at the hearing he failed to support his allegations of discrimination. I find that he has therefore failed to establish a prima facie case of discrimination.
