1. Non Implementation Of A Rights Commissioners Decision R-050262-wt-07.
BACKGROUND:
2. An application has been made by the employee that Decision R-050262-wt-07 has not been implemented by the employer
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 (the Act) from Josef Gorski of Asgard, Church Road, Tullamore, Co Offaly (complainant) that Garry Plant Hire, of Tower House, Clonminch, Tullamore, Co Offaly (employer) failed to implement a decision of the Rights CommissionerR-050262-wt-07.
As the said decision not having been carried out by the employer and no appeal having been brought against the said decision within the time limit for such appeal, the Court hereby determines that, in accordance with the decision of the Rights Commissioner, the said employer pay to the said employee the sum of €5000.00 awarded in respect of breaches of the Act.
