1. Alleged non-implementation of a Rights Commissioner's Decision R-051169-MW-07/DI.
BACKGROUND:
2. A Labour Court hearing took place on the 10th July, 2008. The following is the Determination of the Court:-
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act, 2000 (the Act) from Leonor Cordero, c/o John Ferris, of 8 Georgian Village, Castleknock, Dblin 15 (complainant) that Polden Catering Ltd, T/A Avalon House Hotel, The Square, Castlecomer, Co. Kilkenny (employer) failed to implement a decision of a Rights Commissioner, No. r-051169-mw-07-DI, dated 7th March, 2008
And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
The Court hereby determines that, in accordance with the decision of the Rights Commissioner, the said employer pay to the complainant the sum of €9,249.87 awarded in respect of breaches of the Act.
