1. Complaint that the Decision of a Rights Commissioner has not been complied with R-065305-WT-08/JOC.
BACKGROUND:
2. The worker referred her case to the Court on the 6th May, 2009, in accordance with Section 31(1) of the Minimum Wage Act, 2000. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 31(1) of the Minimum Wage Act, 2000, (The Act) from Weronika Marek, of 35 The Grove, Kingswood Heights, Tallaght, Dublin 24 (Complainant) that Gdansk Polish Food Distribution Limited (c/o Paul W Tracey (Solicitors) of 24 Marlborough Street, Dublin 1) (Employer) failed to implement a Decision of a Rights Commissioner No. r-065305-wt-08/JOC, dated 5th March 2009,
As the said Decision has not been carried out by the Employer,
And no appeal has been brought against the said Decision within the time limit for such an appeal,
The Court hereby determines that, in accordance with the Decision of the Rights Commissioner, the said Employer pay to the Complainant the sum of €1500.00 awarded in respect of breaches of the Act.
