1. Complaint that a Rights Commissioner’s Decision has not been implemented r-052751-hs-07/JOC.
BACKGROUND:
2. A complaint was submitted in accordance with Section 29(8) of the Safety, Health and Welfare at Work Act, 2005. The following is the Determination of the Court:
DETERMINATION:
A complaint having been received under Section 29(8) of the Safety, Health and Welfare at Work Act, 2005 (the Act) by Mr. John Rock, 23 Fairview Avenue, Dublin 3, that Western D�cor Limited, 12 Ruxton Court, Lower Dominick Street, Galway, Co. Galway, failed to implement a Decision of a Rights Commissioner, No. r-052751-hs-07/JOC dated 23rd June 2008.
And the said Decision not having been carried out by the employer,
And no appeal having been brought against the said Decision within the time limit for such appeals,
The Court hereby determines that in accordance with the Decision of the Rights Commissioner the said Respondent pay the Complainant the sum of €5,000.00 in respect of the breach of the Act.
