1. Complaint That The Decision Of A Rights Commissioner No. R-076981-Mw-09/Eh has not been implemented
BACKGROUND:
2. The worker referred his case to the Court on the 22nd September, 2009, in accordance with Section 31(1) of the Minimum Wage Act, 2000. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 31(1) of the National Minimum Wage Act, 2000 from Marek Kasprzak, 19 Talbot Street, Dublin 1, that his former employer, Braun Transport Limited, The Cottage, Kilcorry, Clonegad, Co. Carlow, failed to implement a Decision of a Rights Commissioner r-076981-nw-09/EH.
And the said Decision not having been carried out by the employer, and no appeal having been brought against the said Decision within the time limit for such appeal,
The Court hereby determines that the said employer pay to the said employee €1,026.55 in compensation, and €150 by way of reimbursment of expenses incurred, in accordance with the Decision of the rights Commissioner.
