1. Complaint that a Rights Commissioner’s Decision has not been implemented R-067781-Wt-08/EH
BACKGROUND:
2. The worker referred her case to the Labour Court on the 25th June, 2010. The following is the Court's determination:
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act 1997 by Ms Anele Jakiel, C/O MRCI, 55 Parnell Square West, Dublin 1 that her employer, Lynette and Hopewell Kawonza, 17 The Way, Hunters Run, Clonee, Dublin 15 failed to implement a decision of a Rights Commissioner R-067781-wt-08/EH. And the said decision not having been carried out by the employer, and no appeal having been brought against the said decision within the time limit for such appeal,
the Court hereby determines that the said employer is required to pay Ms Anele Jakiel compensation of €5,000.00 within six weeks of the said date of this Determination so as to comply with the Decision of the Rights Commissioner.
