Determination:
This hearing was scheduled to commence at 2.30pm. The Tribunal waited until 2.45pm before commencing proceedings. The Tribunal was satisfied that the Appellant and Respondent were duly notified of the hearing by registered post. However, there was no appearance by them, or representation on their behalf.
The Tribunal noted the content of the T2 form (Notice of Appearance) which was submitted by the Respondent on 19 March 2009 and whereon was stated that redundancy had been paid to the Appellant. A copy of the RP50 form was also submitted with the T2 form, and on same was indicated that the Appellant had signed for receipt of his redundancy payment on 13 March 2009.
As there was no attendance by or on behalf of the Appellant, the appeal under the Redundancy Payment Acts, 1967 to 2007 fails for want of prosecution.
