The determination of the Tribunal was as follows:-
There was an unexplained absence of the claimant at the hearing. The representative of the claimant applied for liberty to re-enter should he be able to contact his client subsequently.
The Tribunal granted liberty to re-enter on or by 6th November 2009 provided that the respondent be given seven days notice of intention to re-enter and that a clear reason be out-lined to the respondent as to why claimant did not attend on 6th October 2009.
There was no application for liberty to re-enter received on or before 6th November 2009 and therefore the Tribunal dismisses this claim.
