1. Complaint that a Rights Commissioner’s Decision has not been implemented WT70455/07/MR
BACKGROUND:
2. The Worker's representative referred the case to the Labour Court on the 10th August 2009, in accordance with Section 28(8) of the Organisation of Working Time Act, 1997. The following is the Labour Court's Determination:-
DETERMINATION:
A complaint having been received under Section 28(8) of the Organisation of Working Time Act, 1997 by Dusan Marsala care of Murphy Ramsay Walsh Solicitors, 12 Ashe Street, Tralee, Co. Kerry that his former employer, Bryan Hanson, Ballydwyer West, Ballymacelligott, Tralee, Co. Kerry failed to implement a Decision of a Rights Commissioner WT70455/07/MR.
And the said Decision not having been carried out by the Employer and no appeal having been brought against the said Decision within the time limit for such appeal.
The Court hereby determines that the said Employer pay to the said Employee
€2,000.00 in accordance with the Decision of the Rights Commissioner.
