The decision of the Tribunal was as follows:-
The appellant commenced work as a cashier on 1 November 2001 but the store where she worked ceased trading in November 2008. (She had initially worked sixteen hours per week but her number of hours had subsequently gone down.) She sought a redundancy lump sum and a minimum notice payment but received neither.
No evidence was offered by or on behalf of the respondent.
Determination:
Under the Redundancy Payments Acts, 1967 to 2007, the Tribunal finds that the appellant is entitled to a redundancy lump sum based on the following details:
Date of Birth: 03 August 1955
Date of Commencement: 01 November 2001
Date of Termination: 28 November 2008
Gross Weekly Pay: €107.04
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
In addition, the Tribunal awards the appellant the sum of €428.16 (this amount being equivalent to four weeks’ gross pay at €107.04 per week) under the Minimum Notice and Terms of Employment Acts, 1973 to 2005.
