The decision of the Tribunal was as follows:-
In his written appeal to the Tribunal the appellant stated that he was due redundancy but had not been paid it after an employment that commenced on 29 September 2003 and ended on 27 February 2008.
At the hearing the appellant told the Tribunal that his weekly pay had varied depending on the number of days he worked in a particular week. After documentation was examined his average gross weekly pay was calculated as having been €619.35.
No evidence was offered by or on behalf of the respondent.
Determination:
Under the Redundancy Payments Acts, 1967 to 2007, the Tribunal finds that the appellant is entitled to a redundancy lump sum based on the following details:
Date of Birth: 26 June 1972
Commencement Date: 29 September 2003
Termination Date: 27 February 2008
Gross Weekly Pay: €619.35
It should be noted that payments from the social insurance fund are limited to a maximum of €600.00 per week.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
