The decision of the Tribunal was as follows:
Having heard the uncontested submission from the appellant the Tribunal is satisfied that he was dismissed by the respondent by reason of redundancy. The appeal under the Redundancy Payments Acts, 1967 to 2007 succeeds and the appellant is awarded a statutory lump sum under those Acts and based on the following:
Date of Birth: 28 June 1962
Date of Commencement : 18 September 2003
Date of Termination: 20 March 2008
Gross Weekly Wage €777.00
A weekly statutory ceiling of €600.00 applies to payments from the Social Insurance Fund.
This award is made subject to the appellant having been in insurable employment under the Social Welfare Acts during the relevant period.
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 is allowed and the appellant is awarded €1554.00 as compensation for two weeks’ notice.
