The determination of the Tribunal was as follows:
The Tribunal is satisfied that the respondent was properly notified of this hearing. Neither the respondent nor a representative on his behalf appeared for the hearing. The secretariat of the Tribunal, however, received a form T2 from the respondent on 27 March 2009 related to this case.
That signed form stated that the respondent did not dispute the claims under the above Acts.
Having heard the uncontradicted submissions from the claimant and taking into account the respondent’s T2 form the Tribunal finds that the claimant was unfairly dismissed. Accordingly, he is awarded €25,000.00 as compensation under the Unfair Dismissals Acts, 1967 to 2007.
The appeal under the Minimum Notice and Terms of Employment Acts, 1973 to 2005 also succeeds and the appellant is awarded €433.00 as compensation for one week’s notice.
