1. Appealing against a Rights Commissioner’s Decision r-053302-hs-07/MMG
BACKGROUND:
2. The Employer appealed the Rights Commissioner’s Decision to the Labour Court in accordance with Section 29(1) of the Safety, Health and Welfare at Work Act, 2005, on the 24th September, 2009. The Court sat to hear the appeal on the 22nd June, 2010.
DETERMINATION:
The Employer appealed a Decision of a Rights Commissioner under the Safety, Health and Welfare at Work Act, 2005, r-053302-hs-07/MMG.
The Employer was advised of the time and place for the hearing of the appeal, however he failed to attend at the hearing or to send a representative. In these circumstances the appeal is dismissed for lack of prosecution.
The Court upholds the Rights Commissioner's Decision and so determines.
