1. Appealing Against A Rights Commissioner’S Decision R-067587-Wt-08/JC
BACKGROUND:
2. The employer appealed the Rights Commissioner's Decision to the Labour Court in accordance Section 28(1) of the Organisation of Working Time Act, 1997 on the 31st August, 2009. The employer failed to appear before the Court on 11th March, 2010, the date set for the hearing.
DETERMINATION:
The employer appealed the Rights Commissioner's Decision. He was advised of the time and place for the hearing of his appeal. He failed to attend at the hearing. In these circumstances the appeal is dismissed for lack of prosecution.
The Court upholds the Rights Commissioner's Decision and so determines.
